Alabama DUI Misdemeanor Penalties
In Alabama, the first three DUI offenses are generally considered to be misdemeanors. For a fourth and subsequent offense, your charge will be elevated to a felony DUI.
General DUI penalties are as follows:

1st DUI conviction:
- Could be sentenced to a jail term up to one year and a fine up to $2,100
- Certified ignition interlock on vehicle if BAC reading is above .15
- Mandatory CRO (drug/alcohol classes, testing and monitoring)
- License suspension

2nd DUI conviction:
- Could be sentenced to a jail term up to one year and a fine up to $5,100
- However, there is a mandatory jail time of not less than five days in jail or community service of not less than 30 days
- Certified ignition interlock on vehicle
- Mandatory CRO (drug/alcohol classes, testing and monitoring)
- License suspension

3rd DUI conviction:
- Could be sentenced to a jail term up to one year and a fine up to $10,100
- In addition, there is a mandatory jail time of not less than 60 days in jail
- Certified ignition interlock on vehicle
- Mandatory CRO (drug/alcohol classes, testing and monitoring)
- License suspension

4th DUI conviction:
- A fourth conviction is a felony, and as a result, a person convicted of a fourth DUI could be sentenced to up to 10 years in prison and be ordered to pay a fine up to $10,100
- Certified ignition interlock on vehicle
- Mandatory CRO (drug/alcohol classes, testing and monitoring)
- License suspension
